Terms and conditions of sale
These terms govern every sale concluded on vortekmotoparts.com. They apply in addition to the rights the law grants you as a consumer: they can never reduce them.
Purpose and acceptance
Vortek Motoparts sells motorcycle spare parts and accessories to private and professional buyers within the European Union. Placing an order constitutes acceptance of these terms in the version online at the time of the order; that version is archived with the order.
Products, fitment and availability
Listings describe products with the greatest possible care; images are indicative and are not part of the contract. Stated fitment applies to the model and year range shown: check your machine's year before ordering, and ask us if in doubt. Displayed availability is the one observed when the page was rendered; if an item becomes unavailable after your order, you are informed and refunded without delay.
Prices
Prices are shown in euros, all taxes included, excluding delivery charges. Delivery charges are stated separately in the summary, before any payment. The price binding on you is the one displayed when you confirm the order; if it has changed between adding to basket and payment, the difference is pointed out and a fresh confirmation is requested.
Order and formation of the contract
Ordering takes three steps: basket, delivery, payment. A detailed summary is shown before payment and you can still correct every line at that point. The contract is formed when payment is accepted; a confirmation is then sent to you, and only that confirmation constitutes acceptance of the order.
Payment
Payment is made online, at the time of the order, using the means offered at checkout. No card data passes through our pages or is stored by us: entry takes place in fields hosted by the payment provider, who alone sees them. A declined payment cancels the order with no further effect.
Delivery
The times and charges applicable to your address are shown in the summary before payment. Failing any contrary indication, the goods are delivered no later than thirty days after the contract is concluded. A delay beyond that term entitles you to cancel the order after inviting us to deliver within a reasonable additional period.
Withdrawal, returns and refunds
Consumers have fourteen days from delivery to withdraw without giving a reason and without penalty. The procedure, return postage and the few exclusions provided by law are set out on the « Returns and withdrawal » page. Refunds are made within fourteen days of receiving the return or proof of its dispatch, using the same means of payment.
Legal guarantees, complaints and disputes
Every item sold carries the legal guarantee of conformity for at least two years from delivery, free of charge to you and with no registration requirement. Send any complaint to [email protected] quoting your order number. If our answer does not satisfy you, you may refer the matter to a consumer alternative-dispute-resolution body; the competent courts remain those open to you under the law of your country of habitual residence.
